GLIC Real Estate Holding, LLC vs. Bicentennial Plaza Holding Company, Ltd. 11AP-474 (Tenth Appellate District, Franklin County, Ohio): Represented lender in matter involving credit facility totaling $11 million.  The loan was secured by a class A office building in downtown Columbus.  Defended lender’s interest in fifty year parking lease against attempted termination of fifty year parking lease assigned to lender.

 

GNWLAAC Real Estate Holdings, LLC vs. CCC Real Estate Holdings LLC, et al. 09 CVH03-3908 (Court of Common Pleas, Franklin County, Ohio): Represented lender in matter involving credit facility default totaling approximately $10 million.  The loans were secured by interests in Ohio real estate and personal properties.  B&B lawyers assisted the lender through a complicated and contested work-out process involving confessions of judgment, receiverships, foreclosure and deeds in lieu of foreclosure. 

 

GLIC Real Estate Holding, LLC vs. 2014 Baltimore-Reynoldsburg Road, LLC 09CVH03-3901 (Court of Common Pleas, Franklin County, Ohio): Successfully defended seller of retail building against prospective purchaser’s complaint for breach of contract and fraud claims.

 

Tidewater Finance Company v. Cherhonda Gunn (In re Gunn 09-35870), APN 09-03249 (United States Bankruptcy Court For The Northern District of Ohio, Toledo Division: Sucessfully represented lender in an Adversary Proceeding to make a debt non-dischargeable in bankruptcy.

 

Tidewater Finance Company v. Dean A. Wyrick et. al. (In re Gunn 09-33745), APN 09-03207 (United State Bankruptcy Court For The Northern District of Ohio, Toledo Division: Sucessfully represented lender in an Adversary Proceeding to make a debt non-dischargeable in bankruptcy.

 

In re Nelson, 11-20015 (United States Bankruptcy Court For the Northern District of Ohio, Cleveland Division): Represented Creditor in action to deny discharge of debtor.  Discharge of Debtor was denied.
